1. General

This document is a public offer by “ISHJOY GROUP” LLC (the “Provider”) — a proposal to enter into a paid-services agreement on the terms set out below with any legal entity or sole trader (the “Client”) that has placed an order for a paid service in the employer panel.

Services are provided through the IshJoy platform: the ishjoy.uz website, the employer panel at app.ishjoy.uz, and the mobile apps for Android and iOS (the “Service”).

This offer supplements the Terms of Use and the Privacy Policy, which form an integral part of it. Where they differ on paid services, this offer prevails.

2. Acceptance

This offer is accepted when the Client places its first order for a paid service in the employer panel: when the Provider issues an invoice for payment, or when a payment provider confirms an online payment. From that moment the agreement is concluded on the terms of this offer and is assigned a number of the form OFFR-00001, which the Client can see in the employer panel under “Packages & Billing”, on the “Documents” tab.

The agreement is concluded once. Later orders are placed under the agreement already in force, are evidenced by invoices and do not conclude a new agreement; the agreement number does not change.

By placing an order, the Client’s representative confirms that they are authorised to act on its behalf.

Registering a company in the employer panel is not in itself acceptance of this offer and creates no payment obligation. Use of the free features of the Service is governed by the Terms of Use and the Privacy Policy.

No single paper document is required. If the Client needs a bilateral contract, it sends a request to support@ishjoy.uz; such a contract is executed in addition to this offer and does not replace it.

3. Subject matter

The Provider grants the Client access to the paid recruitment features of the Service:

4. Packages and units

Services are sold in packages. A package contains a set number of units of each kind: standard, premium and VIP publications, and boosts. Units of different kinds are not interchangeable.

The contents, unit counts and price of each package are shown in the employer panel at the time of purchase. The Provider may change the contents and prices of packages; a change does not apply to packages already paid for.

Individual vacancies may be paid for one at a time, without buying a package, where the panel offers that option.

5. Price and payment

Prices are stated in Uzbek soums and shown in the employer panel before a purchase is confirmed. The price shown at checkout is final for that purchase.

Payment is made by one of the methods available in the panel at the time of purchase: bank transfer against an invoice, or through payment providers. The available payment methods are shown at checkout.

For bank transfers the Provider issues an invoice before payment. The Client’s payment obligation is discharged when the funds reach the Provider’s account or, for online payment, when the payment provider confirms the payment.

6. Validity of a package

A paid package is credited to the Client company’s balance once payment is confirmed and is valid for the period stated at purchase. The default period is 365 calendar days from the date it is credited.

At the end of that period any unused units of the package are cancelled; they are not refunded and are not carried over to other packages.

7. Provision of the services

A service is treated as rendered as units are drawn down from the Client’s balance: when a vacancy is published or boosted in the listing. Each such action consumes one unit of the corresponding kind.

The history of these debits and the current unit balance are shown in the employer panel and serve as the record of the volume of services rendered.

If a vacancy is rejected by the Provider’s moderation, the unit debited for it is returned to the Client’s balance.

Vacancies published by the Client are moderated for compliance with the Terms of Use. Rejecting a vacancy that breaches those rules is not a failure by the Provider to perform its obligations.

8. Accounting documents

The Provider issues an invoice for every sale, available to the Client electronically in the employer panel under “Packages & Billing” on the “Invoices” tab. The invoice states the agreement number and the version of this offer under which the order was placed.

For bank transfers the invoice is issued before payment. For payments through a payment provider the invoice is issued automatically once the payment is confirmed; the record in the panel’s payment history and the payment provider’s receipt serve as additional proof of payment.

Primary accounting documents are prepared in the manner established by the law of the Republic of Uzbekistan and provided on the Client’s request to invoice@ishjoy.uz.

9. Rights and obligations

The Provider undertakes to give access to the paid features of the Service that have been paid for, and to preserve the Client’s unit balance for the validity period of the package.

The Provider may carry out maintenance that temporarily restricts access to the Service, change its functionality, and reject or take down vacancies that breach the Terms of Use or the law.

The Client undertakes to publish only genuine vacancies of a real company, to state working and pay conditions accurately, and to use candidate data received solely for recruitment, complying with personal data law as an independent controller.

The Client may stop using the Service at any time. Doing so does not entitle the Client to a refund of unused units, except where the law provides otherwise.

10. Liability

The Provider is a platform for publishing vacancies and is not a party to employment relationships. The Provider does not guarantee that the Client will receive applications, find a suitable candidate, or conclude an employment contract; the absence of such a result is not a failure to render the service.

The Provider’s liability under this agreement is limited to the value of the services paid for by the Client in the period in which the breach occurred. The Provider is not liable for the Client’s lost profits.

Nothing in this offer excludes liability that cannot be excluded by law.

11. Refunds

Refunds are handled in the manner established by the law of the Republic of Uzbekistan, on the Client’s request to support@ishjoy.uz.

The value of units already drawn down is not refundable, as the corresponding services are treated as rendered at the moment of the debit.

12. Force majeure

The parties are released from liability for non-performance caused by force majeure, including failures of trunk communication and power networks, acts of state authorities, and other events beyond the parties’ reasonable control.

13. Governing law and disputes

This offer is governed by the law of the Republic of Uzbekistan. Disputes are resolved through negotiation and, failing agreement, in the manner established by the law of the Republic of Uzbekistan. Before going to court, a party sends a written claim to support@ishjoy.uz; the period for answering it is thirty calendar days.

14. Changes to this offer

The Provider may amend this offer. A new version is published at this address with its date and version number and takes effect on publication. Earlier versions remain available at permanent addresses of the form /en/policies/public-offer/<version>/.

Each order is governed by the version in force when the order was placed; that version is stated on the invoice. The terms of packages already paid for are not changed.

The Provider will give notice of material changes in the employer panel or by email. Continuing to use the paid features of the Service after changes take effect means accepting the new version.
